Representative of the GOP: Biden must be indicted or removed. Opinion: There Is No Middle Ground

The nation continues to grapple with the disconcerting report authored by Special Counsel Robert Hur, which details the unequivocal mismanagement of classified documents by President Joe Biden subsequent to his tenure as vice president. Determining whether Biden’s flagrant disregard for the law or the report’s determination that he is mentally incompetent to stand trial is more surprising is difficult.
We have all witnessed Vice President Biden stumble through speeches and down staircases, but this nonpartisan special counsel’s report significantly heightens concerns regarding the president’s ability to carry out the responsibilities of his office. Mr. Hur advised against the filing of charges against President Biden despite his conclusion that he intentionally and knowingly removed, mishandled, and disclosed classified documents on multiple occasions over decades. He stated that “Mr. Biden would likely present himself to a jury at trial, as he did during our interview with him, as a sympathetic, well-meaning elderly man with a poor memory.”
The reasoning of the special counsel was disconcerting. Mr. Hur recounted a multitude of occurrences in which President Biden demonstrated significantly impaired cognitive abilities. He provides several instances as illustrations, including the president’s inability to recollect the year he was vice president or the year his son Beau passed away, as well as specifics of an Obama administration debate he participated in concerning Afghanistan. Hur proceeds to explain how Biden’s interviews with his ghost-writers in 2017 already exhibited signs of cognitive decline, including instances of “painful slowness” and “at times, Mr. Biden struggled to recollect events and exerted effort to read and relay his own notebook entries.” Following this, Hur concludes that the president’s mental deterioration is so pronounced that it is not prudent to press charges.

It is unnecessary to reiterate to the special counsel and attorney general that selective prosecution is unethical, illegal, and immoral. We do not prosecute or refrain from prosecuting individuals on the basis of their personalities or the expected public perception of them. The special counsel is obligated to file charges if he determines that the evidence provides a reasonable foundation for doing so. Ethically, the Department of Justice is precluded from indicting former president Donald Trump on charges of mental acuity, while simultaneously declining to indict President Biden on the grounds of cognitive decline. President Biden requires criminal charges.
Barring a lack of mental capacity to withstand a trial.
In all honesty, the report of the special counsel reasonably suggests that he is not. It is extremely concerning that President Biden cannot recall the name or date of any elected office he has ever held. However, the inability to recollect the date of one’s child’s death, even after several years have passed, is arguably even more terrifying. In actuality, the president might lack the capacity to stand trial.
If this is indeed the case, then President Biden is unquestionably incapable of carrying out his presidential duties. As a consequence, the cabinet is obligated to initiate the necessary procedures to remove the president in accordance with the 25th Amendment of the United States Constitution. In an effort to prevent a recurrence of the assassination of President John F. Kennedy, the 25th Amendment was ratified by the states and Congress subsequent to the event. However, President Biden and his administration have concealed his evident decline from the American people by avoiding public appearances and interviews.
This situation is tantamount to a crisis and a breach of trust. Mr. Hur’s reports make it abundantly clear that this decline has been apparent for years. The American people have the right to a president who safeguards the nation, upholds the Constitution, scrupulously implements congressional laws, and maintains complete transparency regarding his health and mental faculties.
Whether or not President Biden is to be prosecuted, he must be removed. No middle path exists.
